Terms & Conditions – Training Tools

 

1. Ordering

Orders can be made online, by post, or telephone.

All prices are subject to VAT at the current rate unless stated.

If you pay using a credit or debit card:

  • We take payment from your card at the time carry out your purchase
  • A confirmation email will be sent to you confirming your purchase. You will also receive an email from WorldPay confirming your payment
  • Goods will be released for dispatch once the card payment is confirmed by WorldPay.

If you pay by BACS:

  • It is your responsibility to carry out the BACS payment by contacting your bank.
  • Goods will not be released for dispatch until the funds have reached our bank account.

2. Delivery

Goods will normally be delivered within 10 days of being released for dispatch.

In the event of an item being out of stock we will advise you by email or using other contact details you provide. We will advise you when the required item will be in stock and confirm that you still wish to proceed with the order.

The goods will be dispatched by royal mail or another reputable carrier.

Delivery times are then out of our control as we are dependent on the carrier and you agree not to hold us responsible for their delays.

You will check the goods on delivery and notify us immediately (within 2 working days) of any damage or shortfall.

The Development Company Limited will not be responsible for goods damaged in transit if signed for with no reference to condition being notified to the carrier at the time of delivery.

You must check deliveries before signing a receipt from the carrier.

If the item you have ordered is faulty or defective, you must return it to us unused and in its original condition within 14 days for a prompt replacement, exchange or refund

In the case of non-delivery or missing parcels, normal channels will be pursued before replacement or compensation is allowed.

Risk of loss and damage of products passes to you on the date when the products are delivered or on the date of first attempted delivery by us.

The laws of England will govern this contract and both parties agree to submit to the non-exclusive jurisdiction of the English courts.

The Development Company Limited shall be under no liability for any delay or failure to deliver products or otherwise perform any obligation as specified in these terms and conditions if the same is wholly or partly caused whether directly or indirectly by circumstances beyond its reasonable control.

The failure of The Development Company to enforce any one or more of the terms of this agreement at any time or for any period shall not be a waiver of such terms or of the right to enforce all terms and conditions of this agreement at any subsequent time.

3. Data Protection

The Development Company Limited may submit customer personal data to a credit reference agency for the purposes of credit checking.

The Development Company Limited agrees not to give or sell any customer information to any third party for the purposes of marketing or selling.

The Development Company Limited may contact the customer form time to time with special offers or information that may be of interest to the customer. The customer may instruct The Development Company Limited in writing to cease this contact.
